"K. Notwithstanding the Virginia Public Procurement Act, the Department of Conservation and Recreation may establish non-competitively procured contracts with private non-profit organizations that are exempt from federal taxation to conduct revenue producing activities on department-owned lands provided the revenue generated after expenses is used to benefit the Division of State Parks or other department programs. This paragraph shall not permit the establishment of contracts for capital improvements to state-owned facilities or department-owned lands."
